1. Acceptance of Terms
By accessing or using Autofair (www.autofair.co.za), you agree to be bound by these Terms of Service and all applicable laws and regulations of the Republic of South Africa. If you do not agree with any of these terms, you are prohibited from using this site.
2. Use of the Platform
Autofair is a vehicle marketplace platform connecting private sellers, registered dealerships, and buyers across South Africa. Users must be 18 years or older to register and transact. You agree not to post false, misleading, or fraudulent vehicle listings. All listings are subject to review and approval by the Autofair moderation team.
3. Dealer Accounts
Dealerships must complete the dealer registration process and be approved by Autofair before accessing dealer features. Subscription fees are billed monthly or annually. Autofair reserves the right to suspend or terminate dealer accounts for violations of these terms or for non-payment.
4. Listing Rules
All vehicle listings must accurately represent the vehicle being sold. Sellers must have legal ownership or authority to sell the listed vehicle. Autofair reserves the right to remove any listing that violates our policies, contains illegal content, or is deemed inappropriate.
5. Trade Floor
The Trade Floor (Dealer Bid) is an exclusive platform for approved dealers to bid on private seller vehicles. Bids constitute a binding offer to purchase at the stated amount. Autofair facilitates the connection between parties but is not responsible for the outcome of any transaction.
6. Payments and Refunds
Listing fees and subscription fees are non-refundable unless required by South African consumer protection law. All prices are quoted in South African Rand (ZAR) and include VAT where applicable.
7. Privacy
Your use of Autofair is also governed by our Privacy Policy and POPIA Compliance Notice, which are incorporated into these Terms by reference.
8. Limitation of Liability
Autofair is a marketplace platform and is not a party to any transaction between buyers and sellers. We make no representations or warranties regarding the accuracy of listings. To the maximum extent permitted by law, Autofair shall not be liable for any indirect, incidental, or consequential damages.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
